General terms and conditions of use
These General Conditions aim to provide for all the conditions of access and use of the Site accessible at the address www.iberimo.com.

Access to and use of the site accessible at www.iberimo.com (hereinafter the "Site") implies the Visitor's tacit and unconditional acceptance of these Conditions, in their latest version online. "Visitors" are understood, in this context, as any natural or legal person connecting to and navigating the Site.
1. Description of the Site
1. The Editor offers on the Site the reservation of accommodations of various categories in the territory of Spain, but also in other territories, the list of which is accessible on the Site's homepage. The Editor provides on the Site thematic information about each accommodation and its characteristics, including occupancy schedules and rates, as well as tourist information about the geographical areas where the accommodations are located.
2. While the reservation of stays on the Site is subject to payment and acceptance of the general terms of sale, access to and consultation of the Site, including all sheets related to each of the accommodations referenced by the Editor, are entirely free. The Editor is entirely free in the choice of the selection and organization of the information, especially the accommodations offered for reservation, as well as the features and services accessible on the Site. The Editor also reserves the discretionary right, at any time and without notice, to edit and delete all or part of this information and accommodations offered for reservation, as well as to modify and temporarily or permanently suspend all or part of the features and services offered on the Site.
3. For any questions about the Site and the activities of the Editor, Visitors are invited to contact IBERIMO at the contact details at the beginning of these Conditions.
2. Access and Availability
1. Access to the Site is ensured continuously and permanently, except in cases of force majeure or events beyond the control of the Editor, and subject to any breakdowns and technical interventions, maintenance, and updates necessary for the proper functioning of the Site, each of these events being likely to result in a disruption of access to the Site.
2. Moreover, due to the very nature of the Internet, IBERIMO cannot guarantee the operation of the Site 24 hours a day, 7 days a week.
3. Liability
1. The Editor strives to provide the most reliable and qualitative information on the Site, especially regarding accommodations and related services, as well as tourist information about the geographical areas where the accommodations are located. However, IBERIMO is not bound by an obligation of result and does not provide a guarantee of accuracy, timeliness, and completeness regarding all information accessible on the Site.
2. IBERIMO cannot be held responsible for direct or indirect damages suffered by Visitors or third parties that originate from the information disseminated on the Site, and more generally, from the consultation and use of the Site.
3. IBERIMO also exercises no surveillance over sites linked to the Site through hyperlinks and disclaims any responsibility related to these sites and the content found on them.
4. Intellectual Property
1. All data of any kind, including texts, questionnaires, graphics, logos, icons, images, audio or video clips, trademarks, software, features on the Site, are necessarily protected by copyright, trademark law, and all other intellectual property rights, and belong to the Editor or to third parties who have authorized the Editor to use them. The Editor grants the Visitor a private, non-collective, and non-exclusive right to use these contents, to the extent permitted by the features of the Site and these Conditions.
2. The Visitor undertakes to use the information accessible on the Site fairly and honestly, in accordance with its intended purpose, for its own needs only, and undertakes not to trade it with third parties without prior express authorization from the Editor. Without incurring civil and criminal liability, the Visitor also undertakes not to reproduce, summarize, modify, alter, or redistribute, without the prior express permission of the Editor, all or part of the content referred to in this Article 4.
3. The entire Site, as well as all web pages dedicated to each of the accommodations offered for reservation on the Site, including all of their content and consultation methods, constitute the Databases of the Site. These Databases are the exclusive property of IBERIMO and are protected by the provisions of the Intellectual Property Code relating to copyright, and by the law of July 1, 1998 transposing the European Directive of March 11, 1996 on the legal protection of Databases. In these conditions, the Visitor notably refrains from reproducing, translating, adapting, arranging, transforming, communicating, representing, and distributing, permanently or temporarily, by any means and in any form whatsoever, all or part of the data contained in these databases, other than in cases mentioned in paragraph 4.1 of these Conditions.
The use of software and other robots designed to scrape websites, for the purpose of extracting information from the Site automatically, is prohibited in these conditions.
5. Confidentiality and Personal Data
This Privacy Policy was last updated on May 25, 2018. We may update this Privacy Policy, so please check it regularly for updates.
1. In accordance with the provisions of Law No. 78-17 of January 6, 1978, relating to information technology, files, and freedoms, and the decision of the CNIL (National Commission for Information Technology and Liberties) of July 10, 2006, to eliminate the obligation to declare Internet sites in favor of the procedure for declaring treatments associated with said site, IBERIMO has declared its client/prospect file with the CNIL.

They are intended for marketing, commercial, and accounting services (our database is not sold to any telemarketing site).

The recorded information is reserved for the use of the concerned service(s) and can only be communicated to the following recipients: Real estate agency in charge of the accommodation. Some of these recipients are located outside the European Union, especially in: Spain. These recipients will have access to the following data: Name, first name, nationality, identity card number, or passport number.
The transmission of this data to recipients located outside the European Union is an obligation to declare the occupants to the Spanish authorities.
The following guarantees have been taken to ensure a sufficient level of protection of personal data: The country offers an adequate level of protection.
They are retained for 3 years, and in accordance with the amended "Information Technology and Liberties" law of January 6, 1978, you have the right to access and rectify the information concerning you.

5 bis. Information about cookies
1. To enable the use of the Site, the Visitor is informed that one or more cookies (data files) will be placed on their hard drive for a limited duration.
Cookies do not contain any personal information; their role is mainly to identify the Visitor during their connections to the Site and facilitate their navigation on the Site.
Cookies are also used to establish statistics regarding the Site's attendance and navigation modalities, including:

4. These conditions are governed by French law for both substantive and procedural rules.
Any dispute arising from the execution or interpretation of the provisions of this contract obliges the parties to come together and try to find an amicable solution to their dispute before resorting to the competent jurisdiction.
IN THE CASE WHERE THE VISITOR IS A PROFESSIONAL, THE DISPUTE WILL BE BROUGHT BEFORE THE COMMERCIAL COURT OF SAINT-ETIENNE (42), NOTWITHSTANDING THE PLURALITY OF DEFENDANTS OR CALL IN WARRANTY.
